1. Introduction

1.1 We are committed to safeguarding the privacy of our website visitors, buyers, sellers, valuation clients and other service users.

1.2 This policy explains how we collect, use, disclose, retain and protect personal data when we act as a controller and determine the purposes and means of processing.

1.3 In this policy, “we”, “us” and “our” refer to Adam Partridge Auctioneers & Valuers, incorporating Adam Partridge Limited, Adam Partridge South West Limited and Bainbridges of Ruislip Limited. These companies act as joint controllers. Their company details, registered office and operating locations are set out in section 13. The relevant operating company will also normally be identified in your contract, invoice or other transaction documentation.

1.4 This policy should be read with any additional privacy information provided when we collect personal data.

2. How we use your personal data

2.1 We process the categories of personal data described below for the stated purposes and legal bases.

2.2 Usage data. We may process information about your use of our websites, auction platforms and services, including IP address, approximate location, browser and device information, referral source, visit duration, page views, navigation paths and service-use patterns. We use this information to operate, secure, analyse and improve our websites and services. Our legal bases are our legitimate interests in administering and improving our business and, where legally required for non-essential cookies, consent.

2.3 Enquiry and valuation data. We may process information submitted in enquiries, valuation requests and appointment bookings, including contact details, descriptions and images of property and related correspondence. We use it to respond, provide estimates or services and administer our relationship. Our legal bases are steps taken at your request before entering a contract, performance of a contract and our legitimate interests in operating our business.

2.4 Customer and account data. We may process your name, contact information, account credentials, preferences, device and website activity, bidding history, purchase and payment history and communications. We may collect this information when you register or bid in person, online, by telephone or by commission or absentee bid. We use it to register and administer accounts, review bidding applications, provide auction and valuation services, communicate about transactions, prevent misuse and maintain records. Our legal bases are contract, legal obligation and our legitimate interests in properly managing, securing and protecting our customer relationships and services.

2.5 Transaction and payment data. We may process contact, billing, payment and transaction information relating to purchases, sales, commissions, fees, refunds and deliveries. We use it to perform contracts, process and reconcile payments, keep accounting records, prevent fraud and deal with queries or disputes. Our legal bases are contract, legal obligation and our legitimate interests in administering and protecting our business. We do not normally retain complete payment-card details where these are entered directly into a payment provider’s secure system.

2.6 Marketing data. We may process contact details and preferences to send catalogue alerts, newsletters and other marketing. The legal basis is consent where required, or our legitimate interests where electronic-marketing law permits. You may unsubscribe at any time.

2.7 Correspondence data. We may process communications and associated metadata to communicate with you, maintain records and establish, exercise or defend legal claims. Our legal bases are contract and our legitimate interests in administering our business and protecting legal rights.

2.8 CCTV data. CCTV operates at our premises for the safety and security of visitors and staff, the protection of property and premises, and the prevention and investigation of crime, fraud, incidents and disputes. Our legal bases are our legitimate interests in safety, security and protecting our business and customers, and legal obligation where applicable. CCTV recordings are normally retained for up to 30 days, but relevant footage may be retained longer where required for an incident, investigation or legal claim.

2.9 Call recordings. We may record telephone calls, including calls relating to bidding, for security, staff training, quality assurance, transaction verification, dispute resolution and the prevention or investigation of fraud. Our legal bases are contract and our legitimate interests in securing transactions, maintaining service quality, training staff and protecting customers and our business. Recordings are kept only for as long as reasonably necessary for these purposes, taking account of any complaint, dispute, investigation or legal requirement.

2.10 We may process personal data to comply with legal and regulatory obligations, obtain insurance, manage risk, receive professional advice, protect vital interests or establish, exercise or defend legal claims.

2.11 We may receive information about you from a person acting on your behalf or with whom you are connected, including an authorised bidder, agent, representative, executor, administrator, beneficiary, beneficial owner, company officer, joint owner, collector or person introducing you to us. This is particularly relevant to probate valuations, deceased estates, business customers, family collections and third-party collection arrangements.

2.12 Please do not provide another person’s personal data unless you are authorised to do so and have given them any required privacy information.

3. Anti-money laundering and customer due diligence

3.1 We are required to comply with the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017, as amended (“Money Laundering Regulations”). Before establishing a business relationship, entering an occasional transaction and at other times required by law, we may carry out customer due-diligence, enhanced due-diligence, ongoing monitoring, sanctions and related checks.

3.2 Personal data received for the purposes of the Money Laundering Regulations will be processed only:

  • for preventing money laundering, terrorist financing or proliferation financing;
  • where another use is permitted by other applicable legislation or UK data-protection law; or
  • where we have obtained your consent to the proposed additional use.

3.3 Identity requirements apply to all bidders, regardless of their previous history with us or intended spend. To approve a registration, we ask for a valid form of photographic identification, such as a passport, driving licence, identity card or government-issued bus pass, or recent proof of address, such as a utility bill, bank statement or other official document dated within the previous three months. Depending on the circumstances and risk, we may request further evidence and may also process date of birth, nationality, occupation or business activities; bank, payment and transaction information; source of funds or wealth; beneficial ownership and representative information; and the results of identity, sanctions, Politically Exposed Person and adverse-media checks. Information may include special-category data or information relating to criminal convictions and offences where processing is lawful and necessary.

3.4 Information may be obtained from you; a person acting on your behalf or connected with you; GoAuction or another bidding platform through which you register; public registers and publicly accessible sources; ArtAML and its verification or screening providers; credit-reference or fraud-prevention agencies; and government or law-enforcement bodies.

3.5 Our legal bases are compliance with a legal obligation under Article 6(1)(c) UK GDPR and, where applicable, performance of a task carried out in the public interest under Article 6(1)(e). Processing under the latter basis includes lawful and necessary processing under the Money Laundering Regulations to prevent money laundering, terrorist financing or proliferation financing. Any sensitive processing will also satisfy an applicable condition under the UK GDPR and Data Protection Act 2018.

3.6 Providing information requested for AML checks is a statutory requirement. If you do not provide it, or we cannot satisfactorily complete the checks, we may be unable to register you, establish or continue a business relationship, accept a bid, receive property for sale, make or receive a payment or complete a transaction. We may suspend or end an account or relationship and may take other action required by law.

3.7 Identification documents should be uploaded securely to the auction platform through which the customer registers. Information uploaded through adampartridge.co.uk is stored by GoAuction. If a customer cannot upload a document, it may be emailed to the relevant saleroom at the customer’s own risk; after it has been transferred to GoAuction and the transfer has been confirmed, the source email and attachment will be deleted from the relevant mailbox, subject to technical backup and legal retention requirements.

3.8 We use ArtAML Limited to provide customer-due-diligence, identity-verification, sanctions-screening and AML compliance services.

3.9 All bidding registrations are manually reviewed. We do not make bidding-approval decisions, or other decisions producing legal or similarly significant effects about customers, solely through automated processing.

4. Providing your personal data to others

4.1 We may disclose personal data, where lawful and necessary, to:

  • ArtAML Limited and its identity-verification, sanctions-screening and AML subprocessors;
  • Go Auction Limited, which provides our auction-management and online auction platform;
  • Tap & Go Limited, Global Payments group companies, merchant acquirers, card schemes and associated payment-service providers;
  • com and Invaluable, where a customer registers, bids or otherwise interacts with us through those independent auction platforms;
  • Banks, fraud-prevention and credit-reference agencies, shipping and logistics providers and other suppliers needed to complete transactions;
  • Professional experts assisting with authentication, attribution or valuation; restorers and conservators; photographers; storage and collection providers; catalogue printers and mailing providers; and event or valuation-day partners;
  • Our insurers, professional advisers, auditors, IT providers and secure records-management providers;
  • HM Revenue & Customs and other supervisory or regulatory authorities;
  • The National Crime Agency, law-enforcement agencies, courts and other public authorities; and
  • Other parties where disclosure is necessary to comply with law, protect vital interests or establish, exercise or defend legal claims.

4.2 Some recipients act as processors under our instructions. Others, including payment providers, financial institutions and public authorities, may act as independent controllers where they determine their own purposes and means of processing.

4.3 We may be prohibited by law from informing you about certain disclosures, including the making or existence of a Suspicious Activity Report (SAR).

4.4 We disclose only the information reasonably necessary for the relevant purpose. Where an optional disclosure to an authentication, valuation, conservation, photography, storage, catalogue or event partner requires consent, we will obtain it first. Where disclosure is necessary to provide a service you requested, perform a contract, comply with law or pursue a legitimate interest, we rely on the corresponding lawful basis rather than consent.

4.5 We may disclose information where any joint controller sells, transfers, restructures or considers selling or transferring all or part of its business or assets, subject to appropriate confidentiality and data-protection safeguards.

5. International transfers

5.1 Some service providers and subprocessors may process or store personal data outside the United Kingdom. ArtAML states that its compliance platform is hosted in the European Union. Go Auction uses cloud, hosting and storage providers. Tap & Go states that information may be transferred outside the United Kingdom, including to Global Payments group companies and external providers.

5.2 Where personal data is transferred outside the United Kingdom, we use a transfer mechanism permitted by UK data-protection law. Depending on the destination, this may include UK adequacy regulations, the UK International Data Transfer Agreement, the UK Addendum to the EU Standard Contractual Clauses or another legally permitted safeguard. You may request information about applicable safeguards from our Data Protection Officer.

6. Retaining and deleting personal data

6.1 We retain personal data only for as long as reasonably necessary for the purposes for which it was collected, including legal, accounting, insurance, regulatory and reporting requirements and the establishment, exercise or defence of legal claims.

6.2 In determining retention periods, we consider the amount, nature and sensitivity of the information, risks from unauthorised use or disclosure, the relevant purposes, whether they can be achieved by other means and applicable legal requirements.

6.3 We normally retain customer-due-diligence records for five years from the end of the business relationship or, for an occasional transaction, five years from completion of the transaction.

6.4 At the end of the applicable AML period, we will delete the personal data unless retention is required or permitted by another enactment, required for court or other legal proceedings, authorised by your consent, or reasonably necessary for anticipated legal proceedings.

6.5 Other transactional, tax and accounting records may be kept for six years or longer where law, a dispute or another legitimate retention requirement applies. Further details of relevant retention periods are available from our Data Protection Officer.

7. Your rights

7.1 Subject to applicable law, your rights may include access, rectification, erasure, restriction, objection, data portability, withdrawal of consent and the right to complain to a supervisory authority.

7.2 These rights are not absolute. In particular, we may be required to retain and process AML information despite an erasure, restriction or objection request.

7.3 Where processing is based on Article 6(1)(e) or our legitimate interests, you may object on grounds relating to your particular situation. We may continue processing where the law requires it or where compelling lawful grounds override your interests, rights and freedoms, or processing is needed for legal claims.

7.4 Where processing is based on consent, you may withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.

7.5 To exercise a right, contact our Data Protection Officer using the details in section 13. We may need to verify your identity and may ask for information needed to locate relevant records.

8. Complaints

8.1 Please contact our Data Protection Officer if you have concerns about our use of personal data so that we can try to resolve them.

9. Security

9.1 We use appropriate technical and organisational measures designed to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access. Access is limited to personnel and service providers with a business need to know and subject to appropriate confidentiality and security obligations.

9.2 No internet transmission or storage system is completely secure. Customers are responsible for keeping account credentials confidential and notifying us promptly of suspected unauthorised access.

10. About cookies

10.1 A cookie is a small file containing an identifier that is sent by a web server to a browser and stored by the browser. It may be a session cookie, which expires when the browser closes, or a persistent cookie, which remains until its expiry date or earlier deletion.

10.2 Cookies do not usually contain information that directly identifies you, but information stored in or obtained from cookies may be linked with other personal data.

10.3 We use necessary cookies to operate and secure our websites and services. Subject to your cookie choices, we may also use analytics or similar technologies to understand use and performance. Further information, including the current cookies and providers used and how to change your choices, is available in our website Cookie Policy and consent controls.

10.4 Subject to your consent, we may use Google Ads, Meta advertising tools (including Facebook and Instagram advertising) and other targeting or retargeting technologies. These providers may use cookies, pixels or similar identifiers to measure campaigns, create audiences and show advertising based on interactions with our websites. Non-essential advertising technologies will not be activated until the required consent has been obtained, and you may change or withdraw your choices through our cookie controls.

11. Third-party websites and services

11.1 When you register or bid through adampartridge.co.uk, GoAuction may collect and process registration, identity, account, device, bidding and transaction information to operate and secure the platform. Relevant information is made available to us so that we can manually review registrations, administer auctions, process winning bids and manage transactions.

11.2 Customers may also register or bid through thesaleroom.com or Invaluable.com. Those platforms ordinarily act as separate controllers for aspects of their services and process information under their own privacy notices. They may provide relevant registration, bidding and transaction information to us so that we can administer the auction and complete transactions.

11.3 You may contact or interact with us through Facebook, Instagram, TikTok, Linkedn, YouTube or WhatsApp. The operator of the relevant platform processes information under its own privacy policy. We may receive account names, messages, comments and other information you choose to provide through those services.

11.4 Our websites and services may contain links to other third-party websites or integrate third-party services. Those organisations may act as independent controllers and have their own privacy information. Relevant policies include:

12.1 We may update this policy from time to time by publishing a revised version on our website. Where appropriate, we may also notify registered customers by email or through their account.
